2. Consent to Collection and Use of Data.
You agree that EA may collect, use, store and transmit technical and related information that identifies your computer (including the Internet Protocol Address), operating system, Application usage (including but not limited to successful installation and/or removal), software, software usage and peripheral hardware, that may be gathered periodically to facilitate the provision of software updates, dynamically served content, product support and other services to you, including online services. EA may also use this information combined with personal information for marketing purposes and to improve our products and services. We may also share that data with our third party service providers in a form that does not personally identify you. IF YOU DO NOT WANT EA TO COLLECT, USE, STORE, TRANSMIT OR DISPLAY THE DATA DESCRIBED IN THIS SECTION, PLEASE DO NOT INSTALL OR USE THE APPLICATION.
This and all other data provided to EA and/or collected by EA in connection with your installation and use of this Application is collected, used, stored and transmitted in accordance with EA’s Privacy Policy located at www.ea.com. To the extent that anything in this section conflicts with the terms of EA’s Privacy Policy, the terms of the Privacy Policy shall control.
WTF EA? Everytime the gamer thinks things are going good, you guys do dumb ____! You companies always try to play us as if you don't know some one is paying attention.
Is this the new way now? You think EVERYBODY wants to play BF3 so bad that they will give up their privacy to you and other companies? People buy anti-spyware for this ____ that you guys are pulling! What is going on with videogame companies these days? I know governments and other baddies do this all the time, but why our games?
I just want to play the damn game. I don't want to have to worry about this garbage.

Only comforting if you want to feel good about it, knowing they will do it anyway. This isn't the day and age of trust and just because they have rewritten it to make it sound better, everyone knows what it is.
All they are trying to do is secure their sales and pre-orders. They don't think people will read the terms of service in detail, so if you even think about going up against them in court for your rights:
By accepting these terms, you and EA expressly waive the right to a trial by jury or to participate in a class action.

People are free to do what they want. If they want to play any EA game this bad, they gotcha by the balls doing so. Only on PC do we have to go through this.

Lol by saying comforting i was just being a little sarcastic the worst part though is that origin will be compulsory to play any forthcoming ea games ... bf3 is just the tip of the iceberg sadly..
